Pembahasan diawali dengan definisi hukum internasional, lalu dilanjutkan dengan sejarah perkembangannya, mulai dari zaman Romawi Kuno, Abad Pertengahan, sampai dengan masa sekarang. Berikut pembahasannya. Definisi Hukum Internasional Secara sederhana, hukum internasional sering disamakan dengan aturan- aturan bagi negara-negara di dunia. Pemahaman ini tidak salah, namun dalam perkembangan hubungan internasional, pemahaman ini kurang tepat karena hubungan internasional tidak lagi hanya berkutat pada hubungan antar negara. Hukum internasional dapat didefinisikan dengan dua cara, yaitu cara tradisional dan cara kontemporer. Perbedaan utama antara dua cara tersebut terletak pada pada pandangan masing-masing mengenai siapa saja yang menjadi subjek hukum internasional. Definisi tradisional menekankan bahwa subjek hukum adalah negara-negara pendukung hak dan kewajiban internasional. Definisi seperti ini banyak terdapat dalam berbagai karya tulis di masa lalu. Dalam buku Pengantar Hukum Indonesia, dijelaskan bahwa Brierly mendefinisikan hukum internasional sebagai "himpunan kaidah dan asas-asas tindakan yang mengikat bagi negara-negara yang beradab dalam hubungan mereka, antara satu dengan lainnya."(Dwiyatmi, 2006:72). Definisi ini muncul karena di masa lalu, satu- satunya aktor yang berperan dalam hubungan internasional adalah negara. Berbeda dengan definisi tradisional, definisi kontemporer tidak hanya merujuk pada negara, tapi juga pada aktor lainnya dalam hubungan internasional. Dalam buku Pengantar Hukum Internasional-Edisi Kesepuluh, Starke menyatakan bahwa hukum internasional merupakan aturan-aturan yang mengikat negara-negara; mengatur hubungan dan berfungsinya organisasi- organisasi internasional; mengatur hubungan antara organisasi internasional dengan negara-negara dan individu; serta aturan-aturan yang berkaitan dengan individu dan aktor non-negara, selama hak dan kewajiban mereka merupakan kepentingan masyarakat internasional. (Starke, 2006:3). Senada dengan Starke, Mochtar Kusumaatmaja mendefinisikan hukum internasional sebagai "...keseluruhan kaidah-kaidah dan asas-asas hukum yang mengatur hubungan atau persoalan yang melintasi batas-batas negara, antara negara dengan negara dan negara dengan subjek hukum lain bukan negara atau subyek hukum bukan negara satu sama lain".(Kusumaatmadja, 1999: 2) Definisi kontemporer dikemukakan pada saat hubungan internasional tidak hanya dijalankan oleh negara saja. Jika dilihat pada perkembangan dalam hubungan internasional, maka definisi kontemporer inilah yang lebih tepat menggambarkan keberadaan hukum internasional saat ini. Sejarah Perkembangan Hukum Internasional Sistem hukum internasional yang ada saat ini merupakan hasil dari masa lalu, terutama 400 tahun terakhir. Namun, sejarah sistem tersebut diawali pada masa kuno, dimana telah ada aturan-aturan dan kaidah-kaidah yang mengatur hubungan antar bangsa. Berbagai macam traktat, duta besar, dan lainnya, telah ada beberapa abad sebelum lahirnya agama Kristen. Berikut pembahasannya. . Masa Romawi Pada masa sebelum Romawi Kuno, keadaan yang kacau di berbagai bidang menyebabkan hukum yang mengatur hubungan antar bangsa kurang berkembang. Selain itu, pada masa ini keseluruhan dunia beradab berada dibawah satu imperium Romawi, sehingga hukum internasional dirasa tidak perlu karena semuanya ada di bawah satu kekuasaan. (Starke, 2006:9). Namun, kaidah dan aturan tentang bagaimana berhubungan dengan bangsa lain telah ada pada masa ini. Walaupun sistem hukum Romawi Kuno ini kurang berkontribusi pada hukum internasional, namun tetap berguna karena adanya prinsip-prinsip yang bisa beradaptasi pada hubungan-hubungan antar negara modern. Contohnya, pada masyarakat Romawi Kuno dikenal dua jenis hukum, yaitu Ius Ceville dan Ius Gentium. Ius Ceville adalah hukum yang berlaku bagi bangsa Romawi dimanapun mereka berada. Sedangkan Ius Gentium adalah hukum yang berlaku bagi bangsa non-Romawi. Ius Gentium kemudian berkembang menjadi Ius Inter Gentium atau yang lebih dikenal dengan hukum internasional. (Kusumaatmaja, 1999:4). . Abad Pertengahan Perubahan-perubahan yang terjadi pada abad kelima belas dan keenam belas memengaruhi berbagai bidang. Renaissance (zaman pencerahan) ilmu pengetahuan dan reformasi memicu perkembangan teori-teori yang mendukung kondisi akibat perubahan tersebut. Bermunculannya negara-negara merdeka pada zaman ini menuntut adanya kaidah-kaidah dan aturan-aturan yang mengatur hubungan antara mereka. Negara-negara merdeka tersebut mengambil kaidah dan aturan dari adat istiadat dan praktek-praktek yang ditaati oleh negara-negara tersebut dalam hubungan antar mereka. Para ahli di masa ini telah memperhitungkan perubahan yang terjadi di masyarakat negara merdeka, serta memikirkan dan menulis tentang berbagai permasalahan yang dihadapi dalam hubungan internasional. Apabila tidak ada kaidah dari adat istiadat dan praktek yang ditaati dalam hubungan internasional untuk menghadapi permasalahan tersebut, para ahli hukum wajib membuat prinsip-prinsip berdasarkan nalar dan analogi. (Starke, 2006:11). Para ahli tidak hanya mengambil prinsip Romawi Kuno, tapi juga dari berbagai sumber lainnya,seperti hukum kanonik, hukum semi-teologis, dan hukum alam. Para penulis pelopor perkembangan hukum internasional bermunculan di masa ini, misalnya Vittoria (1480-1546), Belli (1502-1575), Brunus (1491- 1536), dan lain-lain, terutama Grotius (1583-1645). Tulisan para ahli hukum ini mengungkapkan pokok perhatian hukum internasional pada abad keenam belas, yaitu perang antar negara, berkaitan dengan kondisi dimana tentara negara-negara Eropa telah menggunakan senjata tetap, sehingga muncul adat istiadat dan praktek peperangan yang serupa.
